Summary
Malik says about enemy men found on the coast of Muslim land, claiming they were merchants and that the sea cast them ashore: the Muslims do not know the truth of that, except that their ships were broken or they were thirsty and landed without permission of the Muslims. Malik holds that this is for the imam, who judges them as he sees fit, and holds that the one who captured them owes no fifth on them. 1
