Summary
Malik said of a man who kills a man deliberately or puts out his eye deliberately, and the killer is killed or the eye of the one who put it out is put out before retaliation is taken from him: he owes neither blood-money nor retaliation; because the right of the one who was killed or whose eye was put out lies in what has gone, and retaliation is due to him only against the one who killed him. If the killer dies, there is no retaliation or blood-money for him; this is taken from the verse of al-Baqara about retaliation. 1
