Summary
Malik reported that the agreed practice among them regarding accidental wounds is that the wound is not compensated until the one wounded recovers and is healthy. If a bone of a person is broken accidentally, a hand, a leg, or other part of the body, and it heals and returns to its form, there is no blood-money for it; if it is shortened or has a deformity, there is blood-money in proportion to what is lost. For what the Prophet ﷺ fixed as a set amount, it is in proportion; for what has no set amount or sunna, it is determined by judgment. 1
