- Malik ibn Anas
- Ruzayq ibn Hakim al-Ayli
Summary
Malik transmits from Ruzayq ibn Hakim al-Ayli that a man called Misbah employed his son, seemingly slow to him, and said to him: you adulterer. Ruzayq brought the matter before the court; when he was about to flog him, the son said: by God, if you flog him, I will confess to adultery against myself. The matter became unclear, so Ruzayq wrote to Umar ibn Abd al-Aziz, who was then governor, and he wrote to him to permit his pardon. He also wrote to him: if he pardons, allow his pardon for himself; but if he slandered his two parents, and they have died or one of them, then take the prescribed punishment for him, unless he wants concealment. 1
