Summary
Malik transmits from Ruzayq ibn Hakim that he took a runaway slave who had stolen, and his status became unclear, so he wrote to Umar ibn Abd al-Aziz, because he had heard that the hand of a runaway slave who steals while running away is not cut off. Umar wrote back the opposite: God mentions in His book the ruling on the male and female thief; if the theft reaches a quarter of a dinar or more, cut off his hand. 1
