Summary
Malik said: if a man frees a third of his slave while he is ill, and that manumission is made final, then the whole of him is freed from his third. That is not like a man who frees a third of his slave after his death, because if the one who frees a third of his slave after his death had lived, he would have retracted it, and his manumission would not have taken effect. The slave whose master makes final the freeing of a third in his illness, if he lives, the whole of him is freed; if he dies, he is freed in the third, because the testator's word is valid in his third as the healthy person's word is valid in all his property. 1
