Summary
He said: and I heard Malik say of someone who bequeaths a third, saying: so-and-so gets such and such, and so-and-so gets such and such, naming sums of his property, and the heirs say: it exceeds a third. The heirs have the choice: either they give the bequest-holders their bequests and take all of the dead man's property, or they divide a third of the dead man's property among the bequest-holders and hand them that third, so their rights in it are whatever they reach, if they wish. 1
