Summary
Yahya said: I heard Malik say: the practice among us regarding a slave who finds lost property and consumes it before the term set for lost property has passed, which is the Sunna: it is a debt on his neck. Either his master pays the price of what his slave consumed, or he hands over his slave to them. If he holds it until the term set for lost property comes, and then consumes it, it is a debt owed by him, which he is pursued for; it is not on his neck, and his master owes nothing about it. 1
