Summary
Yahya said: I heard Malik say: the practice among us regarding a man who rapes a woman, whether virgin or previously married: if she is free, he owes her the dower of her equal. If she is a slave-woman, he owes what her price was reduced by. The punishment falls on the one who raped, and no punishment falls on the one who was raped in all of that. If the one who raped was a slave, it falls on his master, unless the master chooses to hand him over. 1
