Summary
Malik says of a man who has a hundred dinars owed to him by another for a term, and when it falls due, the debtor says: sell me goods whose price is a hundred dinars in cash, for a hundred and fifty on a term. Malik said: this is a sale that is not proper, and the scholars have always forbidden it. The reason it is disliked is that he gives him the price of the goods that he sold, and postpones the first hundred until the term he named the second time, and adds fifty dinars for the delay. This is disliked and not proper. It resembles the report of Zayd ibn Aslam about the sale of the Jahiliyya. 1
