Summary
Yahya transmits from Malik, from Yahya ibn Said, from Salim ibn Abdallah, that Abdullah ibn Umar sold a slave of his for eight hundred dirhams, with a disclaimer of defects. The buyer said to Abdullah ibn Umar: there is a disease in the slave that you did not tell me about. They brought the dispute before Uthman ibn Affan (may God be pleased with him). The man said: he sold me a slave who had a disease he did not name to me. Abdullah said: I sold him with a disclaimer. Uthman ruled that Abdullah ibn Umar should swear that he sold the slave while he had no disease he knew of. Abdullah refused to swear, took the slave back, and when he was cured, sold him for one thousand five hundred dirhams. The editor notes that Abu Musab and Suwayd transmitted the report from Malik, from Zayd ibn Aslam. 1
