Overview

The Book of Renting Land (Kira al-Ard) is the twentieth book of the Muwatta in the transmission of Yahya ibn Yahya al-Laythi from Malik ibn Anas, in the edition of Bashshar Awwad Ma'ruf (1997), in the second volume. It occupies pages 249 to 250 in the PDF pagination, and contains 6 numbered texts (2073–2078) in one chapter. It concerns the renting of land, what is permitted in it for gold and silver, and what is disliked in it for a share of the yield. 1 2

What the book gathers

  • What is reported on renting land (2073–2078): the Prophet ﷺ's prohibition of renting out fields, and the report of Rafi' ibn Khadij; the sayings of Sa'id ibn al-Musayyab and Salim ibn Abd Allah on renting it for gold and silver; the renting of Abd al-Rahman ibn Awf (may God be pleased with him) and Hisham ibn Urwa; and renting land for a hundred sa' of dates or for what it yields. 1 2

Malik's method in the book

Malik cites the disputed report, then mentions what the people of Medina did in renting for gold and silver, and he disapproves of renting land for a share of its yield because of the uncertainty it involves. 1 2

The editor's notes

The editor quotes Ibn Shihab on the frequency with which Rafi' ibn Khadij narrated, and Ibn Abd al-Barr's explanation of the report. 2

Its place in the museum

Each text of the book has its own record. It names the highest narrator and the chapter, gives the substance of the report in the museum's own wording, and records the editor's takhrij where it is needed. See Hire for the places where its rulings appear in the book. 1
