Summary
Malik said: whoever gives a gift and then the recipient refuses it, and the one who was given it brings a witness who testifies that he gave it, whether goods, gold, silver or an animal, the recipient swears with his witness. If the recipient refuses to swear, the giver swears. If he also refuses to swear, he pays the recipient what he claims against him, if he has one witness; if he has no witness, he has nothing. 1
