Summary
Malik says: whoever buys goods, cloth or slaves, and concludes the sale, then a man asks him to share it, and he agrees, and the seller of the goods receives the full price from both. Then something befalls the goods that takes them from their hands: the partner takes back the price from the one he partnered with, and seeks the whole price from the one who sold the goods to the first. Unless the partner stipulates at the moment of the sale, when the first seller makes the sale, and before anything changes, that the warranty is on the man you bought from. If something changes and the first seller is gone, the second condition is void, and the warranty falls on the buyer. 1
