Summary
Malik says the practice among us is that when a woman embraces Islam while her husband is a disbeliever, and then he embraces Islam, he has the right to her as long as she is in her waiting period. If the waiting period ends, he has no claim on her. If he marries her after her waiting period, that is not a divorce; Islam ends the marriage by annulment, not by divorce. 1
