Summary
A report that Malik transmits from Yahya ibn Sa'id from Sa'id ibn al-Musayyab, who said Umar ibn al-Khattab (may God be pleased with him) said: any man who marries a woman who has madness, leprosy or vitiligo, and then has relations with her, she has her full dowry, and that is a debt for her husband to claim from her guardian. Malik says it is a debt on her guardian only when the guardian who married her out is her father or brother, or someone who is thought to know of this condition. If the guardian is a paternal cousin, a client or a clan member who could not know, there is no debt, and the woman returns what she took of the dowry. 1
