Umar's Governance and Judgments

من سياسة عمر وأحكامه

When Umar appointed an official he registered his wealth, and halved the fortunes of wronging governors — a half to the treasury, a half to them. Long he ate nothing of the fisc till want touched him; he asked the Companions and Ali said 'lunch and supper' — he took that. His letter: no army or raiding amir shall flog a hadd far from the route, lest Satan's zeal carry him to the unbelievers. 'This matter stands only on a firmness without despotism and a gentleness without weakness'. A woman came: 'my husband prays all night and fasts all day' — 'well praised' — Ka'b ibn Suwar: 'she complains — she says he gives her no share' — 'then judge between them: God allowed him four women — she has a day of every four days and a night of every four nights'. And sixteen dinars spent on his hajj — 'Abdallah, we have been extravagant with this money'.

Overview

A collection of reports about the policy and judgements of Umar ibn al-Khattab, as al-Suyuti gives them in "History of the Caliphs". 1

With his governors

When he appointed a governor he recorded his property, and he shared with transgressing governors their wealth, taking half and giving them half. 1

On expenditure

He spent a long time without taking anything from the public money until he was in need, and he consulted the Companions of the Prophet ﷺ. Ali said: "A lunch and a supper," and he took that. 1

In the armies

He wrote that no commander of an army or a detachment should flog anyone with the prescribed punishment until he was on the road. He said that affairs are set right only by firmness without tyranny, and gentleness without weakness. 1

The woman's case

A woman came to him complaining that her husband prayed at night and fasted by day. Umar praised him, and Kab ibn Suwar understood that she was complaining that he did not come near her bed. Umar ordered him to judge between them, and he made it for her a day and a night out of every four. 1

On the pilgrimage

On his pilgrimage he spent sixteen dinars, and he said: "O servant of God, we have been extravagant with this money." 1

Abu Sufyan's mission to Medina

Frightened by what had been done at al-Watir, Quraysh sent Abu Sufyan ibn Harb to Medina to stiffen the pact and extend its term. The Prophet gave him no answer; Abu Bakr and Umar declined to intercede; Ali advised him to grant protection himself, which he did and returned home empty-handed.
