The episode and the votes

The 'Al-Wasatiyya' episode debated the human-rights file in the Arab world: the scale of violation and its causes — the culture of despotism or political tension — and when the 'dawn visitors' saga will end 7 8. The youth voted: 69% judged international covenants practically worthless and 19% of limited use; 1 72% judged the Arab person's situation worse than others' and 10% saw no difference; 2 and only 9% endorsed international intervention while 65% saw the solution as internal 3.

Worthless covenants — and the double standard

Panelists traced the youth's scepticism to the double standard: their example was international envoys rushing to one victim's site while ignoring 220 dead on the other side 9. They added that the big international organisations answer to powers hostile to Arabs and Muslims — though independent rights organisations remain worth resorting to 10.

Rights untaught — entertainment media

They blamed ignorance of treaty-guaranteed rights on their absence from curricula and on officially controlled media preferring entertainment: 14 of the top-20 most-watched programmes in the Arab world are serial dramas — 'where then do people acquire their culture?' 11 12 13 5.

The way — from within, gradually

Panelists advised starting with non-political rights — an honest judiciary and protection of property — before political rights, to avoid collision; 6 14 and agreed international intervention is no answer — reform is internal even if sincere pressures assist 3 10.

Ahliyya (legal capacity: to have rights and duties, and to act; its stages from the womb to full maturity, and what impairs it)

Ahliyya is lexically suitability, and it is of two kinds: capacity to have rights and duties, the capacity of liability; and capacity to act, that is to perform acts recognised by the law. Its bearer passes through the stages of the foetus, childhood, discernment, puberty and maturity. Liability is complete from birth and incomplete for the foetus; the capacity to act is partial at discernment and full with puberty and reason. It is affected by heavenly impediments such as madness, imbecility, sleep, fainting, illness, slavery, menstruation, childbirth and death, and by acquired ones such as ignorance, drunkenness, jest, folly, travel, error and coercion.
