Summary

In his commentary on al-Baqara 2:233, Sha'rawi treats the period of suckling, the child's claim on both parents, and the father's duty of maintenance, and reads weaning as a matter for mutual consent and consultation. 1

Period of suckling

Sha'rawi notes that the verse opens with mothers suckling their children for two complete years for whoever wishes to complete the suckling, and that it states this in the declarative form rather than as a command, presenting it as a natural fact. 1 2

Maintenance of the nursing mother

Maintenance and clothing fall on the one to whom the child is born, because the child is attributed to the father. The mother should keep to what is reasonable, and the father should not harm her by withholding maintenance. 2 3

The heir and the father's death

If the father dies, the same duty falls on his heir, so that the child's right is secured both while the father lives and after his death. 3

Weaning by mutual consent

Weaning before two years is for the parents to decide together by mutual consent and consultation, and the child's shared concern remains after divorce. 4

A hired wet-nurse

If the mother cannot nurse, the father may bring a wet-nurse, and should give her what makes her willing to nurse faithfully. Sha'rawi warns against showing off such arrangements, since one deals with God and not with society. 5

Opinions on the question

The question: How does Sha'rawi read the period of suckling, the nursing mother's maintenance and the child's right after divorce?

First opinion · Sunni tradition (the museum's frame)Main reference

The suckling is stated as a natural fact, not as a command

Sha'rawi notes that the verse states mothers' suckling in the declarative form, presenting it as a natural and unavoidable fact rather than an order that could be obeyed or disobeyed {cite:tafsir-sharawi-khawatir-scan-vol-2 p.1005}. He records that the father is the one charged with the nursing mother's upkeep, because the child is attributed to the father {cite:tafsir-sharawi-khawatir-scan-vol-2 p.1005}.

Divorce (talaq)

In his commentary on al-Baqara 2:228-232, Sha'rawi reads divorce in stages, once and then twice, as giving the couple room to mend; he holds that returning to a wife after the waiting period needs a new contract and a new dower and the woman's consent, and that relatives may not block the return when the spouses agree.
