Summary
Malik said: the agreed practice among us regarding a contract slave held by two partners is that it is not lawful for one of them to settle with him on his share without his partner's permission, because the slave and the slave's property are between them. If one of them settles without the other, and then the contract slave dies with property or becomes unable, the one who settled has no claim on his property, and what he settled is not returned. As for the one who settled with his partner's permission: if the contract slave becomes unable, he may take back what he received and be on his share of the slave. 1
