Summary
Malik says of a man who says to his wife: you are divorced, and every woman I marry is divorced, and my property is charity if I do not do such and such, and then breaks the oath: as for his wives, it is divorce as he said. As for his words that every woman he marries is divorced, if he does not name a particular woman, tribe, or land, or the like, this does not bind him, and he may marry whom he wishes. As for his property, he gives away a third of it in charity. 1
